Terms of Service

These Terms of Service ("Terms") govern your use of the Elio contractor management platform operated by Elio ("we", "us", or "our"). By creating an account or using Elio, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Elio, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to be bound by them. If you are using Elio on behalf of a business, you represent that you have authority to bind that business.

2. Description of Service

Elio provides a cloud-based contractor management platform including job management, invoicing, estimates, scheduling, LiDAR scan processing, AI plan drafting, and payment processing. Features vary by subscription plan.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Subscription and Billing

• The Starter plan is free with limited features.
• Paid plans (Pro at $49/mo, Business at $99/mo) are billed monthly or annually.
• All paid plans include a 14-day free trial. No credit card required for the trial.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not provide refunds for partial billing periods.
• Prices may change with 30 days notice.

5. Payments

Payment processing is handled by Stripe. By providing payment information, you authorize Elio to charge your payment method for the applicable subscription fees. All payments are in USD.

6. Your Data

You retain ownership of all data you upload to Elio. You grant us a limited license to store and process your data to provide the service. We will not access your business data except to provide support or as required by law.

7. Acceptable Use

You agree not to:

• Use Elio for any unlawful purpose
• Upload malicious code or attempt to compromise our systems
• Resell or redistribute access to Elio without authorization
• Use automated tools to scrape or extract data from the platform

8. Intellectual Property

Elio and its original content, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our software or content without permission.

9. Limitation of Liability

To the maximum extent permitted by law, Elio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from the Settings page. Upon termination, your data will be retained for 30 days before deletion.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of Elio after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
